Establishing Revocable & Irrevocable Trusts in Lithonia & the Atlanta Metro Area

Trusts are legal arrangements where one party, known as the trust creator or settlor, transfers property, assets, or funds to another party, known as the trustee, to hold and manage on behalf of third parties, known as the beneficiaries.

Trustees must manage and dispose of assets according to the instructions provided in the trust document created by the settlor. Trusts offer a way to control and protect your assets and distribute them according to your wishes. They can be powerful estate planning tools,  helping to minimize taxes, avoid probate, and provide peace of mind to you and your family.

At E.N. Banks-Ware Law Firm, our experienced team can help you establish trusts tailored to your needs and objectives. We can educate you on the various types of trusts applicable to your circumstances and help you draft and implement comprehensive and legally binding trust documents.

Revocable vs. Irrevocable Trusts in Georgia

A revocable trust, also known as a living trust, is a trust that can be amended, modified, or revoked by the grantor during their lifetime. This trust allows the grantor to control the assets and make necessary changes. Revocable trusts are popular because they provide flexibility and can be structured to convert into an irrevocable trust upon the grantor's death, simplifying asset transfer to beneficiaries.

Once established, an irrevocable trust cannot be altered, modified, or terminated by the grantor except under specific circumstances defined by the trust agreement or by law.

Because the grantor relinquishes control over the assets placed in an irrevocable trust, these assets are generally protected from creditors. They may provide tax benefits, such as reducing estate tax liability.

Types of Trusts

Multiple types of trusts are available for different purposes, needs, and goals.

Common trusts include:

  • Living trust: A revocable trust created during the grantor's lifetime.
  • Testamentary trust: Created through a will and takes effect upon the grantor's death.
  • Charitable trust: Set up to benefit a charitable organization and provide tax benefits for the grantor.
  • Special needs trust: Designed to provide for disabled beneficiaries without affecting their eligibility for government benefits.
  • Spendthrift trust: Protects beneficiaries from creditors by restricting their access to trust funds.
  • Generation-skipping trust: Allows assets to pass to grandchildren or later generations, minimizing estate taxes.
  • Bypass trust: Designed to reduce estate taxes by allowing the grantor's spouse to use the trust assets without including them in their estate.
  • Qualified Personal Residence Trust (QPRT): This trust allows the grantor to remove their personal residence from their estate, reducing estate taxes while continuing to live in the home for a specified period.

What Are the Benefits of Establishing Trusts?

Establishing a trust offers numerous advantages in estate planning. Trusts provide a structured way to manage and distribute your assets according to your stated intentions within the trust document. One notable benefit is that trusts can help minimize estate taxes, thereby preserving more of your wealth for your beneficiaries.

Trusts also offer privacy, as they typically do not go through the public probate process, keeping the distribution of your assets confidential. Establishing a trust can protect your assets from creditors and legal claims, offering a layer of security for your estate.

Trusts can also be designed to support beneficiaries with specific needs, such as a special needs trust for individuals with disabilities, so they receive adequate support without jeopardizing their eligibility for government benefits.

Furthermore, trusts can provide a seamless transition of assets by reducing the delays and costs associated with probate, allowing beneficiaries to receive their inheritance more efficiently.

Whether you wish to support charitable causes, provide for future generations, or want your estate to be managed according to your specifications, trusts offer versatile and powerful tools to achieve these objectives.
